Agreement to Terms

Welcome to the Greenhouse Music Substack publication. By subscribing to, accessing, or using this Substack publication (the “Publication”), you agree to be bound by these Terms of Service (”Terms”). If you do not agree to these Terms, please do not subscribe to or use the Publication.

This Publication is operated by Greenhouse Music, a nonprofit organization dedicated to providing world-class music education in an accessible and affordable format.

Description of Service

Greenhouse Music’s Substack publication provides subscribers with:

  • Educational content about music theory, performance, and pedagogy

  • Articles, essays, and commentary on music and music education

  • Exclusive insights from our faculty and community

  • Updates about Greenhouse Music programs and offerings

Subscription Terms

Free and Paid Subscriptions

The Publication offers both free and paid subscription tiers. Paid subscriptions provide access to premium content not available to free subscribers. Subscription pricing and benefits are described on our Substack publication page.

Payment and Billing

Paid subscriptions are billed automatically on a recurring basis (monthly or annually, depending on your selected plan) through Substack’s payment platform. You authorize Greenhouse Music and Substack to charge your designated payment method for all subscription fees.

Cancellation and Refunds

You may cancel your paid subscription at any time through your Substack account settings. Upon cancellation, you will continue to have access to paid content through the end of your current billing period. We do not provide refunds for partial subscription periods. All cancellation requests and inquiries should be directed to jrose@greenhousemusic.us or managed through your Substack account.

User Conduct and Responsibilities

Account Security

You are responsible for maintaining the confidentiality of your Substack account credentials and for all activities that occur under your account. You agree to notify Greenhouse Music immediately of any unauthorized use of your account.

Prohibited Uses

You agree not to:

  • Use the Publication for any unlawful purpose or in violation of these Terms

  • Share or redistribute paid content to non-subscribers

  • Harass, abuse, or harm other subscribers or contributors

  • Attempt to circumvent payment systems or access controls

  • Use automated systems to access or download content in bulk

  • Misrepresent your affiliation with Greenhouse Music

Intellectual Property Rights

Ownership

All content published through the Greenhouse Music Substack, including articles, images, graphics, audio, video, course materials, and other media (the “Content”), is the property of Greenhouse Music or its licensors and is protected by copyright and other intellectual property laws.

Limited License

Subscribers are granted a personal, non-exclusive, non-transferable, revocable license to access and view Content solely for personal, non-commercial use. You may not:

  • Reproduce, distribute, modify, or create derivative works from the Content

  • Remove any copyright, trademark, or proprietary notices

  • Use Content for commercial purposes without express written permission

  • Publicly perform or display Content except as permitted by these Terms

User Comments and Contributions

If you post comments, questions, or other content on the Publication, you grant Greenhouse Music a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content in connection with the Publication. You represent that you own or have the necessary rights to any content you submit.

Third-Party Services and Links

The Publication is hosted on Substack, a third-party platform. Your use of Substack is subject to Substack’s Terms of Service and Privacy Policy in addition to these Terms. The Publication may contain links to third-party websites or resources. Greenhouse Music is not responsible for the content, accuracy, or practices of third-party sites.

Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using the Publication, you consent to our data practices as described in our Privacy Policy.

Electronic Communications

By subscribing to the Publication, you consent to receive electronic communications from Greenhouse Music, including newsletters, updates, and service announcements. You may opt out of promotional communications at any time through your Substack account settings.

Greenhouse Music does not warrant that the Publication will be uninterrupted, error-free, or free from viruses or other harmful components.

Content provided through the Publication is for informational and educational purposes only. Limitation of Liability

  • Any conduct or content of any third party on the Publication

  • Any content obtained from the Publication

  • Unauthorized access, use, or alteration of your transmissions or content

Indemnification

You agree to indemnify, defend, and hold harmless Greenhouse Music, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

  • Your use of the Publication

  • Your violation of these Terms

  • Your violation of any rights of another person or entity

  • Your violation of any applicable laws or regulations

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Arbitration Agreement

In the event of any dispute arising out of or relating to these Terms or the Publication, the parties agree to resolve such dispute through final and binding arbitration administered by the American Arbitration Association, conducted by a single neutral arbitrator in a mutually agreed upon location in New York. The arbitrator’s award shall be final and may be entered as a judgment in any court of competent jurisdiction. The Federal Arbitration Act shall govern the interpretation and enforcement of this arbitration provision.

Class Action Waiver

YOU AND GREENHOUSE MUSIC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims or preside over any form of representative or class proceeding.

Modifications to Terms

Greenhouse Music reserves the right to modify these Terms at any time. We will notify subscribers of material changes by posting the updated Terms on the Publication with a new “Last Updated” date. Your continued use of the Publication after such changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

Modifications to the Publication

Greenhouse Music reserves the right to modify, suspend, or discontinue the Publication or any part thereof at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Publication.

Termination

Greenhouse Music may terminate or suspend your access to the Publication at any time, with or without cause or notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.

Children’s Privacy

The Publication is not directed to children under the age of 13. If you are under 18, you may use the Publication only with the involvement and permission of a parent or guardian. Greenhouse Music does not knowingly collect personal information from children under 13.

International Users

The Publication is controlled and operated from the United States. If you access the Publication from outside the United States, you are responsible for compliance with local laws and regulations.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Greenhouse Music regarding the Publication and supersede any prior agreements.
